The purpose of these Terms is to inform the general conditions of use that must be observed by you when accessing and using the features of the SPACE website, available electronically at https://spacere.com.br/en/termos-de-uso, with access through any other unauthorized means being strictly prohibited.

1. ACCEPTANCE OF THE TERMS AND CONDITIONS OF USE

2. WEBSITE FEATURES

Through the use of the website, you will have access to information about the company, the services we provide, our contact channels, and the possibility of being redirected to the Property Search application and the Restricted Area (the latter being exclusively for SPACE employees).

In addition to learning about all the services offered by SPACE, you may also get in touch through the Contact Us section available on the website via the Contact Us channel, where you can request more information about our services, our customer support, and our partnerships.

By filling out the form available in the Contact Us section, you may be contacted by SPACE via email, WhatsApp, or phone call. We also remind you that you may, at any time, request to stop receiving these communications through the same channels in which they were presented, provided that this suspension does not affect the handling of the requests made by you.

You may also address matters related to job opportunities and joining our team through the Work With Us section. By filling out the form available in the Work With Us section, you will also have the option to upload your résumé using the Choose File feature. By submitting your information and expressing your interest in joining our team, you may be contacted by SPACE via email, WhatsApp, or phone call.

We also provide the Ombudsman/Report section, where you can share your opinion, file a complaint, or report an issue. We value the quality of our services, and with that in mind, we will contact you as soon as possible via email, WhatsApp, or phone call to assist you in the best possible way.

It is important to note that you may, at any time, request to suspend the receipt of these communications through the same channels in which they were presented, provided that this suspension does not affect the handling of the requests made by you.

Please note that you are solely responsible for the veracity and integrity of the information entered on our website and may be held civilly and criminally liable for the effects of false, irregular, or third-party information.

In addition to the public access sections, the website also provides a Restricted Area, with restricted and exclusive access for employees who have been pre-registered and authorized by SPACE. This section is not accessible to regular visitors.

You, as a SPACE employee, must complete your registration in advance directly with SPACE to gain access to the Restricted Area. Only after this registration and proper authorization will access to the features be granted.

You, as a SPACE employee, upon your first access to the Restricted Area section, acknowledge that the information provided is accurate, precise, and unequivocal, and that you are solely responsible for the information provided and for maintaining the confidentiality of your access password.

We inform you that all website content is available and accessible to everyone free of charge, without the need for any prior registration, except for the Restricted Area section, which is exclusive and restricted to pre-registered and authorized SPACE employees.

4. INTELLECTUAL PROPERTY.

All intellectual property rights arising from and/or related to the services described in these Terms and Conditions of Use, including but not limited to economic copyright, belong solely and exclusively to Space Real Estate Consultoria Imobiliária LTDA. Under no circumstances do these Terms imply, in whole or in part, the transfer of any intellectual property rights.

In this regard, SPACE grants the visiting user and the employee user only a limited, non-exclusive, non-commercial, personal, and non-transferable authorization to access, view, upload, and download the website’s content.

SPACE reserves the right to revoke this authorization at any time and to take all necessary legal measures in the event of non-compliance or violation of these intellectual property rules, subjecting the user to the penalties provided by law, as well as canceling access to and use of all website services.

5. CONFIDENTIALITY.

The user who is an employee of SPACE, upon accessing the Restricted Area section, undertakes to treat as confidential and not disclose to third parties any information related to SPACE, acknowledging that any breach of this confidentiality obligation may cause immeasurable damage and may result in liability under both civil and criminal law, without prejudice to compensation for the actual damages caused.

The confidentiality obligation provided for herein shall remain in force for as long as the information received remains confidential.

6. LIMITED LIABILITY.

a) SPACE shall not be liable for improper use of the website and its functionalities, nor shall it be liable for use in breach of these Terms and Conditions of Use.

b) SPACE shall not be held responsible for erroneous or fraudulent information provided by any user, who shall be solely and completely responsible.

c) The SPACE employee user, upon accessing and using the Restricted Area section, shall be solely responsible for the information entered therein and shall also be fully responsible for safeguarding all account information, such as username, password, recovery emails, or any other information related to access to their account.

d) SPACE shall not be held liable for any damage or event caused by third parties, whether directly or indirectly, including but not limited to damages or losses resulting from virus attacks, device intrusions, hackers, system failures, server issues, internet connection problems, or the use of software that may damage physical or technological assets as a result of the transfer of data, files, images, texts, audio, or videos contained on the website when accessed by the user.

e) In this regard, SPACE advises all users to use devices with licensed and updated systems, as well as to employ antivirus and anti-intrusion software, in addition to following good internet usage practices, which include but are not limited to ethics, morality, legality, and good faith.

f) SPACE  shall not be liable for damages resulting from technical difficulties or failures in the systems or the Internet. It will also not be responsible for the unavailability of the system due to any other fortuitous event or force majeure beyond its control.

g) SPACE reserves the right to interrupt the operation of the website and its functionalities, temporarily or effectively, and no compensation will be due to users.

h) SPACE is not responsible for your navigation through external links that may be made available on the SPACE website. It is your responsibility to read the Terms and Conditions of Use and the Privacy Policy of the website or application accessed (for example, but not limited to, links to Facebook, Instagram, LinkedIn, YouTube, etc.).

i) SPACE  is not responsible for the accuracy, suitability and control of the data and information made available on any websites or applications, as mentioned in item "h" above, and it is your duty to check the reliability of the information and data displayed there before taking any action.

7. USER OBLIGATIONS AND LIABILITIES.

As a condition for using the services offered by the SPACE website, you commit, by accepting these Terms and Conditions of Use, to fully comply with the obligations outlined herein, agreeing to:

a) That you will use the website in accordance with these Terms and Conditions of Use.

b) That when using the website, all information provided is true, accurate, current, and complete, and that you are solely and completely responsible for its truthfulness and accuracy.

c) That you will not provide any false, fraudulent, inaccurate, incomplete, or non-existent information, and should this occur, you will be solely and completely responsible, bearing all legal and contractual consequences.

f) That SPACE reserves the right to deny access to the website and its functionalities, at any time, without prior notice, to anyone, in the event that it detects signs of fraud, abuse or any type of suspicious activity.

g) That SPACE reserves the right to take the necessary legal action and that the user may be held liable for monetary damages, including dispute costs and damages.

h) To commit to notifying SPACE of any indication and/or unauthorized use of the site, as well as any other breach of security of which it becomes aware.

j) Since the user is a SPACE employee, when accessing the Restricted Area section, they declare that they has been previously registered and authorized to access and use the application, acknowledging that access, use, insertion, amendment, or management of data by other user(s) is strictly forbidden. In the event of this occurring, the user will be held responsible and will bear all legal and contractual consequences.

k) Since the user is a SPACE employee and accesses the Restricted Area section, they will be solely and completely responsible for safeguarding all the information in their account, such as username, password, password recovery emails or any other information inherent to their account.

8. AMENDMENT TO THE TERMS AND CONDITIONS OF USE.

SPACE, always seeking to improve its processes, reserves the right to amend these  Terms and Conditions of Use  at any time, either to comply with any regulatory requirements or in the event of changes in its administrative and/or commercial practices.

SPACE will notify you of any relevant changes, however, we ask that you always check these Terms and Conditions of Use to ensure that you understand them perfectly.

9. PRIVACY AND DATA MANAGEMENT

You agree to read the Website Privacy Policy, thereby gaining access to and understanding of how your data is collected, stored, processed, and protected.

CUSTOMER SERVICE CHANNELS: means of contact made available by SPACE so that you can send your questions, inquiries, requests, and complaints related to the website.
